Firm Clients Awarded Treble Damages, Plus Attorneys' Fees, in Breach of Fiduciary Duty Case

Partner Steven M. Frederick and associate Mary-Kate Smith recently obtained a judgment awarding their clients approximately $1,000,000, plus legal fees.  The case arose out of a general partner's failure to make appropriate distributions to the other partners of a limited partnership, whom the firm represented.  After hearing the evidence presented at trial, the Court found that the limited partners proved that the general partner breached his fiduciary duties, and committed statutory theft and conversion.  As a result, the Court awarded the firm's clients three times their compensatory damages, in addition to the attorneys' fees and costs they expended in prosecuting their claims.
